Gun Rights Lobby Prepares To Weigh In On Sotomayor
By Greg Vadala, CQ Staff
With congressional Democrats divided on gun issues and the Obama administration steering clear of the topic, gun rights advocates have bagged new legislative trophies this year and are taking aim at additional targets.
The National Rifle Association (NRA) and Gun Owners of America have an ambitious to-do list. They are preparing to:
•Weigh in on Obama’s nomination of federal appellate court Judge Sonia Sotomayor to the Supreme Court.
•Advance a proposal by Sen. Richard M. Burr , R-N.C., to ensure that veterans are not wrongfully denied the right to bear arms.
•Stave off attempts to close the so-called gun show loophole.
•Beat back efforts to renew the federal ban on some assault weapons, which lapsed in 2004.
Conversely, Democrats eager for tighter restrictions are facing the harsh political reality that, at least for now, they can’t match the gun lobby’s firepower.
Sen. Barbara Boxer , D-Calif., who favors gun control, predicted that gun rights advocates “would win the vast majority” of the upcoming legislative fights, though Sotomayor’s confirmation does not now look endangered.
“It’s just the way it is,” Boxer said. “They really have the votes here more than ever, and it’s more regional than it is party.”
Recent votes tell the story.
Last month, 27 Senate Democrats supported Oklahoma Republican Tom Coburn ’s amendment to credit card legislation (PL 111-24) allowing people to bring concealed and loaded guns into national parks. The measure passed the House 279-147, with support from 105 Democrats.
In February, 22 Senate Democrats helped form a majority for an amendment by John Ensign , R-Nev., that would ease restrictions on gun ownership in the District of Columbia. It was attached to legislation (
Paul Helmke, president of the Brady Campaign to Prevent Gun Violence, said he was frustrated that Democratic leadership didn’t “bottle up” the Coburn and Ensign amendments, both of which were attached to popular legislation.
“Gun rights groups have exploited the fact that Obama has an agenda that he wants to move quickly,” Helmke said, citing the president’s plans for the economy, health care and energy while prosecuting two wars. “Until the president weighs in, it’s going to be tough to advance any [gun control] agenda. It’s not the issue they want to take up right now.”
Chris W. Cox, executive director of the NRA Institute for Legislative Action, said Obama, who supports stronger gun restrictions, is wise to keep the issue out of the spotlight.
“What you’re seeing is a reflection of support for the Second Amendment across the country,” he said. “The reality is that support for the gun control agenda is a political liability. It is bad politics and bad policy.”
As the Senate’s consideration of Sotomayor’s nomination approaches, the NRA staff is scouring her record, Cox said. They are paying close attention to Maloney v. Cuomo, in which a three-judge panel on which she served unanimously rejected a man’s claim that a New York ban on nunchakus, a martial arts weapon, violated his Second Amendment right to keep and bear arms. The opinion stated that the amendment applies only to limitations sought by the federal government, not to those imposed by state or local governments.
Cox said “it has yet to be determined” if the NRA will use the Senate vote on Sotomayor’s confirmation as part of its rankings for senators.
Gun Owners of America, whose membership of roughly 300,000 is dwarfed by the NRA’s 4 million members, takes a much harder line on Sotomayor.
The group’s president, Larry Pratt, said a vote to confirm her would cancel out any previous pro-gun-rights votes cast by congressional lawmakers.
“She’s very hostile to the Second Amendment,” he said. “A vote for her says you don’t really support the Second Amendment. . . . It nullifies all we have achieved and hope to achieve.”
On the legislative front, both groups support Burr’s legislation (
The Senate Veterans’ Affairs Committee, on which Burr is ranking member, approved the measure in May. Burr is looking to attach it to another piece of legislation because Senate Majority Leader Harry Reid , D-Nev., is otherwise unlikely to bring it to the floor.
“It’s sort of a scary bill when you read it,” Helmke said. “It basically says it doesn’t matter if you’re comatose or have Alzheimer’s, you still have the right to own a gun.”
The NRA, which opposed mandates for background checks on the personal sale of firearms, is again ready to fight. In its sights is a bill (
Rep. Carolyn McCarthy , D-N.Y., is cosponsor of a companion measure (
Even proponents of gun control hold out little hope of Congress closing the gun show loophole this year.
“That’s something that we hope will move in this Congress — not this year, but in this Congress,” Helmke said.
Gun rights advocates are also making it difficult for McCarthy and Sen. Dianne Feinstein , D-Calif., to renew the federal semi-automatic weapons ban (PL 103-322) that expired in 2004. McCarthy planned to introduce her bill two weeks ago, but she said Feinstein asked her to hold off so they could introduce their proposals together, probably after the August recess.
Feinstein said she has not ruled out trying to attach the ban to another piece of legislation to get it approved. “I’ll pick my spot,” she said.

Comments
Is the NRA broke? Two weeks ago, my husband got a solicitation phone call from the NRA asking for funds to support their efforts. My husband never owned a gun and was outspokenly anti-NRA, not to mention that he died 6 years ago. Are they desperate?
Accountability, does anyone remember what this means or does Mr. Big Government need to explain it to you Babies. This is the Land of the Free and the Home of the Brave, MY A** its the home of who can cry the loudest and make the most fuss. Well it's time for the entire - Silent Majority to speak up and say "HAY YOU GET OFF OF MY CLOUD".
In regards to Gunman's comment. This is about the citizens of our country taking responsibility for our country. If it isn't a very high voter turn out then it is a shame on our country and it shows that those who didn't vote don't care about our country. Our country is kept free through everyone taking the time to govern it. It isn't supposed to run from the top down. It is supposed to be run from the bottom up. Impeachments need to happen easily and readily if the official has broken the law. This "legislation" and failure to act in the true interests of our country and the common citizen, regardless of age, gender, finances, religion etc needs to stop. Elitism is illegal, yet it happens everyday. Why? Because too many do NOTHING about it. Freedom isn't free, nor is it an entitlement. It must be fought for, through diligent voting and holding elected officials accountable to EVERYTHING they do. Until that time, when ALL of America's people MAKE that happen, we are in danger of becoming a corporatocrity or worse. Message to America; it is exactly as you have allowed it to be.
no NRA is definatly NOT BROKE. fact is obama has been a blessing for NRA. hes grown NRA to well over FIVE MILLION MEMBERS . in fact. membership processing is backlogged almost 6 weeks. thats 5 million members waiting for the politicians to do something to get themselves unelected in the next elections.
Let us never forget that the Second Amendment is not about hunting. It is not about target shooting. It is not about personal defense. It is not about collecting. It is about the citizens having the tools fend off tyranny. It is about keeping the liberty that we have fought and died for. The perfect 2ND Amendment tool at the time of our fore fathers was the muzzle loading long rifle. Today that perfect tool is the fully automatic AK-47. Anti-liberty groups like the Brady Campaign have caused our right to own fully automatic AK-47 to be severely restricted. These restrictions are violations of the letter and spirit of 2ND Amendment. We will not rest until these and all other restrictions on our ability to defend our liberty are removed.
The NRA is not broke, you see there are over 4 million members currently and new members each day. And no we are not desperate, we are recruiting more Americans that own firearms and were not members of the NRA. You see we are getting stronger. When I read comments and articles of this nature I send more money to the NRA and I purchase more bullets, gun powder, high capacity clip and firearms.
This is the Dems achilles heel; those Senators from the Mountain West, Midwest & South. It's the ONLY thing that can derail this nomination.
Be sure that the Tiller Murder and todays shooting at the Holocaust Museusm are at the forefront of all firearms debates.
